GRUPO PRO ORGANIZACIÓN DEL RESIDENCIAL DE MONTAÑA LOS ALTOS DE CERRO AZUL
Somos un grupo de propietarios, que ocupamos nuestras casas como residentes permanentes y de manera frecuente los fines de semana, preocupados por temas diversos relacionados con el Residencial de Montaña Los Altos de Cerro Azul, hemos surgido con el propósito de que podamos organizarnos.
Hicimos nuestra primera reunión en el mes de abril del año 2011 y se trataron temas, entre los más importantes: el Manual de Propietarios, la situación de las Asociaciones existentes, el tema financiero del residencial y la nueva Ley No. 31 del 10 de junio de 2010, publicada en la Gaceta Oficial 26558-A del 18 de junio de 2010, que -entre muchos temas importantes- toca a Residenciales como la nuestra, en el Artículo 2, numerales 4 y 6 y en el parágrafo del mismo artículo señala que se reglamentará las lotificaciones como la nuestra, sin fines de lucro. Esta Ley No. 31 está en proceso de reglamentación final por el Ministerio de Vivienda y Ordenamiento Territorial (MIVIOT).
Nos reunimos, en nuestro propio nombre, con los representantes del Grupo Melo, promotor del proyecto y administrador, con quienes platicamos los temas del párrafo anterior, ya que el Administrador es quien recibe las cuotas que pagamos los propietarios dirigida a cubrir los gastos de administración, conservación, mantenimiento, operación, reparación de las calles y cunetas, limpieza de áreas verdes y recreativas, recolección de basura, control de entrada, vigilancia de las áreas, conservación de bienes comunes el Residencial: los senderos, áreas sociales y recreativas: piscina, canchas de tenis, fulbito, basket y patinaje y la opción para el uso de las instalaciones del Club-Restaurante..
El primer logro fue que los propietarios pudiéramos participar, contribuir y aprobar en reunión del 10 de septiembre de 2011, el contenido del proyecto Manual de Propietarios elaborado por la Autoridad Nacional del Ambiente (ANAM), en conjunto con el Grupo Melo. Este Manual representa para todos nosotros una gran responsabilidad por tener el privilegio de que nuestras residencias estén dentro del Parque Nacional Chagres.
Como parte de las actividades y compromiso de este Grupo Pro Organización del Residencial de Montaña Los Altos de Cerro Azul, se tomó el tiempo para investigar y conocer la condición de las actuales asociaciones, mismas que han sido creadas por el promotor, de las cuales hay 8 asociaciones registradas en el Ministerio de Gobierno y Justicia y 7 debidamente inscritas en el Registro Público, quienes igualmente tienen los estatutos que rigen estas asociaciones. Esta documentación se pondrá disponible a todos los propietarios en nuestra próxima comunicación.
Las calles de las lotificaciones del Residencial de Montaña Los Altos de Cerro Azul, y otros temas están regulados en la Resolución No.20-2003, del 21 de febrero del 2003, publicada en la Gaceta Oficial No. 24757 del 11 de marzo del 2003:
-Artículo 2 dice “Aplicación: El concepto de calle privada no podrá ser aplicado en proyectos de interés social. Sólo se utilizará para proyectos de viviendas que sean de mediano y alto costo…”
-Artículo 7, punto ó acápite 7 dice: “ Requisito: Deberá contar con una garita o portón de control de entrada”
-Artículo No. 11 dice “Asociación: El proyecto de Urbanización que se apruebe con el sistema de calles privadas tendrá una Asociación de Residentes….”
Por estos motivos consideramos que es necesario iniciar un grupo organizado que coadyuve al logro de varios objetivos con la participación y representación de cada una de las barriadas o lotificaciones que tiene este Residencial, dispuestas a comprometerse en la conformación de diversos Comités de trabajo. Se hará necesario, por Ley, que aunamos esfuerzos y asumamos nuestro rol como propietarios en coordinación con el Grupo Melo.
Es necesario mantener un canal de enlace entre propietarios que permita un intercambio de comunicación permanente.

HISTORICAL SUMMARY
PRO-ORGANIZATIONAL GROUP OF RESIDENCIAL DE MONTAÑA LOS ALTOS DE CERRO AZUL
We are a group of owners who occupy our houses in Los Altos de Cerro Azul (ACA), some as permanent residents and others as week-end residents. We are very much concerned with environmental, community and several other issues related to the area, and as such we believe in getting ourselves organized.
We first got together as a group in April 2011, and initially concentrated on the “Manual de Propietarios (MP)”; on the existing Property Owners (Residents’) Associations (POAs); on some of the financial statements for the administration of ACA and also Panama´s new property law no. 31, approved last June 18 2011 and published in the “Gaceta Oficial (Public Registry newspaper). This new law will eventually regulate gated communities such as ours, as stated in its article 2, sub-articles 2 & 6. In addition there is a transitional paragraph that specifies that the regulations for POAs such as ours is being drawn up by the Ministry of Housing (MIVIOT) .
In representation of ourselves, and nobody else, we initiated meetings with the Developer and Administrator of ACA, the Melo Group to discuss some of the above issues. The Melo Group, as Administrator, collects and spends the sums we pay (TSM) for administration, conservation, maintenance, operations, road repairs, garbage disposal, entry control, guard services, etc.
Our first important achievement was getting the National Environmental Authority (ANAM) to allow our group to submit environmental modifications and other additions to the Property Owners’ Manual furnished shortly after the first meeting in July 2011. These additions were eventually voted on and those that met with public approval were added to the document in the meeting that took place on the 10th of September 2011. This Manual specifies our responsibilities as privileged residents of the Chagres National Park.
Another of our activities was aimed at getting fully acquainted with the status of the existing POAs taking time to gather documents, by-laws, information held in public registries and details of boards of directors.. We took the necessary steps to investigate and clarify the present conditions of the nine (9) different POAs that were created by the developer. Of these associations, eight (8) are registered with the Panama´s Ministry of Government & Justice, but only seven (7) are properly registered in the Public Registry Office. The associations all have different By-Laws and Regulations affecting their members – i.e. ourselves. These documents will be shortly made available to all of the community in our next Community Brief.
With regards to the private nature of streets and roads within the community, these issues are regulated in the “Resolución No.20-2003, of the 21 February 2003 (Official Regulation)”, published in the Official Public Registry newspaper No. 24757 of the 11th of March 2003 stating as follows (the translations is ours):
-Article 2 states “Application: The concept of private Street cannot be applied to social interest projects. It is only to be used for housing project of medium & high value…” (El concepto de calle privada no podrá ser aplicado en proyectos de interés social. Sólo se utilizará para proyectos de viviendas que sean de mediano y alto costo…”)
-Article 7 states: “Requirement: Should have a gate for entry control” (Deberá contar con una garita o portón de control de entrada”)
-Article 11 states “Asociation: The urbanization Project that meets approval for the private streets system shall have a Residents’ Association” (El proyecto de Urbanización que se apruebe con el sistema de calles privadas tendrá una Asociación de Residentes...”)
We believe that to reach our objectives, it is necessary to involve a larger and more representative organized group, with the participation of each and every one of the neighborhoods in the ACA community. It will be necessary to pool resources and assume our roll as property owners in coordination with the Melo Group.
Since it will be necessary to have a practical means to make all important information available to all the concerned residents, we believe that the email-account losaltosdecerroazul@gmail.com should be a suitable channel to forward through these messages. For this purpose and if you wish to receive further information, we shall appreciate you sending your e-mail account, the name of the owner, the name of the neighborhood (urbanization), lot or house number, and phone or cellular phone number.
Finally, we must say that with a group mail, each and every one of us homeowners will have the opportunity to be informed of important information regarding our property, to review and add comments about such matters, to make suggestions and discuss in an orderly and objectively fashion delicate community issues taking into account all the different views and opinions.
We need your support and we invite all of us to cordially participate in this quest to make the best of our community and maintain the value of our properties.
