Calles Privadas/Private Streets

LEGISLACIÓN 28-2003 DEL 21 DE FEBRERO DEL 2003: Esta disposición legislativa se refiere a las calles privadas que no son traspasadas al Estado y construidas por el Promotor del proyecto. Estas calles fueron aceptadas por el MOP y certificadas como calles privadas. En su artículo 10, se establece que los propietarios serán los únicos responsables del mantenimiento y ornato de las calles privadas, y en su artículo 11 indica que la urbanización tendrá una Asociación de Propietarios. También establece que el Promotor deberá entregar el proyecto a los propietarios al finalizar su desarrollo, además cuales serán las responsabilidades del Promotor y hasta cuando deberá cumplir, y cuando se inician las responsabilidades de los propietarios. En PACAR sentimos que estas disposiciones pueden hacernos responsables y es por ello que le solicitamos a la Administradora Los Altos de Cerro Azul, S.A. que notifique a todos los propietarios del Plan de Mantenimiento Anual. Creemos que tenemos si vamos a tener la responsabilidad, también tenemos que tener el derecho de preguntar sin que le moleste a la Administración. NADA MÁS ESO!

LEGISLATION 28-2003 OF FEBRUARY 21 2003: This legislative action refers to private streets that are not transferred to the government and constructed by the Developer in private lands. Cerro Azul´s streets were accepted and certified as private streets by the Ministry of Public Work (MOP). In article 10 of this legislation, it is established that the owners are to be solely responsible for street maintenance and improvement, and in article 11 it is also stated that the urbanization (Estate) shall have a Home Owners Association.
It is also stated that the Developer shall turnover the housing project to the new owners at the end of the development phase of the housing project, besides it also states his responsibilities where and when alongside with the incoming home owners responsibilities. We feel that this legal requirement can make us solely responsible for this issue and this is basically what moved us to solicit the Administration for a maintenance plan for this year. We believe that if we are going to have the responsibility, then we should also have the right to ask without it bothering the Administration. NOTHING MORE THAN THAT!
