Continuando con lo escrito anteriormente, quisiera explicarles como estos mala-pagas hacen para no pagar su TSM (deben $379 mil dolares al 2011):

En los estatutos de las Asociaciones de Propietarios hechos en 1984-1990 existe un artículo (No,9) que señala que la cuota de mantenimiento es de $5.00 para los lotes con mejoras y $3.00 para lotes sin mejoras. Ese mismo artículo también señala que para cualquier incremento se rquerirá voto de la mayoría de los miembros en Asamblea General. Estos mala-pagas se aferran a estas dos disposiciones para no pagar o la cuota completa o para no pagar nada!

La nueva ley 31 lidia con este problema en los artículos 19 al 24 y específicamente en artículo 25 faculta al Administrador para actuar legalmente.

“Artículo 25: Cuando alguno de los propietarios se niegue a pagar el valor de las cuotas de gastos comunes por un término de dos meses o más, según lo dispuesto en esta Ley, la Junta Directiva o, en su defecto, El Administrador podrá entablar en contra de éste un proceso ejecutivo para lograr el pago, sirviéndole de título ejecutivo el estado de cuenta o los recibos no pagados.
A los propietarios morosos en el pago de las cuotas de gastos comunes por un término de dos o más meses, La Junta Directiva o, en su defecto, el Administrador podrá anunciar en lugar visible la morosidad y suspender o cortar el acceso, beneficio y uso a las áreas comunes …..!

Como verán, con esta nueva ley, el Administrador estará facultado legalmente y podrá publicar los nombres de los morosos en cualquier medio público!, incluso periódicos locales.

Naturalmente tendríamos que tener una Asociación de Propietarios funcional y una Junta de Directiva de Propietarios para que esto pueda darse!

Continuing with my previous post, I would like to explain how these non-paying dead-beats avoid paying their TSM (they owe $379 thousand dollars as 2011).

In the by-laws of Homeowners Associations (HOA) drawn up around 1984-1990 there is an article (No. 9) which states that the maintenance fee is $ 5.00 for lots with improvements and $ 3.00 for unimproved lots. The same article also states that any increase requieres a majority vote of members at General Assembly. These dead-bets cling to these two provisions to avoid paying the full fee or not paying at all!

The new law 31 deals with this problem in Articles 19 to 24 and Article 25 specifically authorizes the Administrator to act legally.

"Article 25: When one of the owners refuse to pay the value of the common expenses (TSM) for a period of two months or more, as provided in this Act, the Board or, alternatively, the Administrator may initiate against it to achieve an executive process payment, enforceable by serving the account statement or unpaid bills.
In the event that the owners delinquent in the payment of common expenses for a period of two or more months, the Board or, alternatively, the Administrator will announce in a visible place the outstanding common expenses due and suspend or cut access, benefit and uses of common areas .....!

As you see, with this new law, the Administrator is authorized by law and may publish the names of the debtors in any public medium!, Even local newspapers.

Naturrally we must have a working Homeowners Association & Board of Directors elected among owners from for this to be enforced!
